RedBalloon Recruiter Referral Terms and Conditions
**1. Referral Program Overview**
By participating in the RedBalloon Recruiter Referral Program you agree to the following terms and conditions. The referral program is designed to enable individuals to become official "RedBalloon Recruiter referral partners" and earn a fee for successful referrals to RedBalloon Recruiter services.
**2. Referral Responsibilities**
2.1 As a RedBalloon Recruiter referral partner, you are responsible for reaching out to pro-freedom businesses, introducing them to RedBalloon Recruiter, and connecting them with our sales team. After that point, RedBalloon is solely responsible for its relationship with the referred business.
2.2 You will earn a fee of $500 for each business that submits payment for RedBalloon Recruiter services through your efforts. You will only be paid a referral fee for businesses with whom RedBalloon has not had previous contact, as determined by RedBalloon in its sole discretion. Prior to any engagement with the referred business, you must receive written approval from the designated member of the public relations team (currently Luke@redballoon.work), and the business must adhere to the conditions outlined in clauses 2.6 and 2.7 for the referral to be deemed valid.
2.3 In the event of a successful referral, you are required to send a signed 1099 tax form to RedBalloon before receiving your referral fee. Once your 1099 is on file, RedBalloon will pay referral fees within 30 days of its receipt of payment from the referred business.
2.4 Prior to making any referrals, you must submit the details of the business you wish to refer in writing to the designated member of the public relations team (currently Luke@redballoon.work). Upon receipt of your submission, RedBalloon will review the provided information and determine the eligibility of the referred business for participation in the referral program.
2.5 Approval of the referred business by the designated member of the public relations team (currently Luke@redballoon.work) is necessary for the referral to be considered valid. RedBalloon reserves the right to decline any referral in its sole discretion, without the need to provide justification.
2.6 For the referral to remain valid, the referred business must contact RedBalloon within 7 days of being approved by the designated member of the public relations team (currently Luke@redballoon.work), expressing interest in RedBalloon Recruiter services.
2.7 Furthermore, the referred business must complete payment to RedBalloon for RedBalloon Recruiter services within 30 days of being approved for referral by the designated member of the public relations team (currently Luke@redballoon.work). Failure to do so will result in the referral being considered void.
2.8 In the event that the referred business completes payment after the 30-day period from the date of approval by the designated member of the public relations team (currently Luke@redballoon.work), the referral will not be eligible for a referral fee.
**3. Dispute Resolution**
3.1 The rights and obligations of the parties shall be governed by and construed in accordance with the laws of the State of Idaho.
**4. Miscellaneous**
4.1 Either party may terminate this agreement immediately upon written notice. In addition, RedBalloon reserves the right to modify, suspend, or terminate the referral program at any time for any reason.
4.2 Nothing contained in this Agreement shall be construed to create a partnership, joint venture, employment relationship, or other agency relationship between the parties. You are solely responsible for your taxes, withholdings and other similar statutory obligations. Neither party has any authority to act on behalf of the other party or to enter into any contract, incur any liability or impose any legal obligation or to make any representation on behalf of the other party.
4.2 In no event shall RedBalloon’s liability under this Agreement exceed the fees it has actually paid or owed to you pursuant to this Agreement.
4.3 These terms and conditions constitute the entire agreement between RedBalloon and the referral partner, superseding any prior agreements or understandings.
By participating in the RedBalloon Recruiter Referral Program, you acknowledge that you have read, understood, and agreed to these terms and conditions. RedBalloon reserves the right to update these terms at its discretion.
